Pfizer Inc. said Wednesday it has received a $2 billion settlement by the United States Attorney’s Office regarding the trafficking of counterfeit versions of its top drug, Viagra.
“Pfizer has been granted a stay in custody and we are taking a significant step in bringing this case to court,” said U. S. Attorney Andrew Witty. “The pharmaceutical industry’s role is to protect consumers, not to profit from the drug’s side effects.”
Viagra, marketed as the first of a new class of drugs for erectile dysfunction, was the first of the drugs to be approved for use in the United States. The generic version is currently manufactured by Pfizer. Pfizer’s largest drug, Cialis, is now marketed as “the next generation of the anti-impotence drug.”
Viagra’s manufacturer said the company will receive $1 billion in proceeds from the settlement. The company also said it will pay a $5 million fine to the U. Attorney’s Office for failing to comply with U. Food and Drug Administration regulations.
The United States Attorney’s Office said it is reviewing whether the Viagra settlement is appropriate.
“Pfizer has the right to be confident that the drug is safe and effective,” said John Lechleiter, special agent in charge for the federal government’s Office of Criminal Investigations in Philadelphia, Philadelphia.
Lechleiter’s office said he was not aware of a specific figure for the number of days of manufacture and sale between December 2007 and January 2010.
Viagra, Cialis and Levitra are sold by various companies including Eli Lilly and Co., Merck & Co., GlaxoSmithKline and Sanofi.
Viagra is not a narcotic, and some online pharmacies may sell counterfeit versions. A spokesman for Pfizer said the company is in a “non-negotiable” position to take steps to protect consumers and is cooperating with U. Customs and Border Protection.
The Viagra settlement, which has not been approved by the U. Food and Drug Administration, provides Pfizer with an opportunity to seek a regulatory victory on the counterfeit drug issue. The U. Food and Drug Administration will have to decide whether Pfizer can take legal action against counterfeit pharmaceutical companies for allegedly facilitating the trafficking of Viagra.
“Pfizer is committed to protecting consumers who purchase medicines from these companies,” said Dr. David A. Nierenberg, Pfizer’s head of consumer health. “It’s important for consumers to be informed of the risks of taking counterfeit medicines and to understand the importance of responsible drug use.”
A spokesman for Pfizer said the company will continue to manufacture and sell Viagra and Cialis.
“Pfizer is committed to protecting consumers, not profit from the drug’s side effects,” said Lechleiter. “As a consumer health advocate, I’m sure you all know the risks and side effects of taking counterfeit medicines. I also know the importance of being informed and involved in making informed choices about the use of medicines.”
Lechleiter said Pfizer is seeking legal action to protect consumers from counterfeit versions of the drug.
“Pfizer is seeking a stay from the Food and Drug Administration until the court decides whether to approve Pfizer’s Viagra product for sale,” said Lechleiter.
In August, the FDA issued an order banning the sale of drugs containing sildenafil, the active ingredient in Viagra. Sildenafil is a prescription medicine used to treat erectile dysfunction. It is not currently available to men who do not have erectile dysfunction, a condition where the inability to achieve and maintain an erection lasts for more than four hours. Viagra can be purchased without a prescription.
Viagra and Cialis are marketed and sold by a different pharmaceutical company, called Eli Lilly and Company, that is the original manufacturer of Viagra. Eli Lilly’s patent on Viagra expired in April 2012 and in October 2012, the FDA issued a warning about counterfeit versions of the drug.
Pfizer said it will continue to manufacture and sell Viagra, Cialis and Levitra. The FDA will monitor Pfizer’s operations. Pfizer will continue to manufacture and sell the drugs.
